It is always better practice to have every contract in writing to serve as better evidence in court. However the state law requires the Nikah Nama provided under the law to be signed and registered. Under Shariah Law, a verbal Nikkah is just as good as a written one. Once signed, it needs to be registered with the local Union Council’s Registrar under the same law. Nikah Nama is an official requirement under the Muslim Family Law Ordinance 1961. “They (your wives) are clothing (covering) for you and you too are a clothing (covering) for them.” (Surah 2, Verse187) There must be two Muslim witnesses of the marriage contract. It’s a binding contract which could be verbal or on paper is considered integral to a religiously valid Islamic marriage, and outlines the rights and responsibilities of the groom and bride. Both the groom and the bride are to consent to the marriage of their own free wills. In Islam, Nikkāh is a legal contract between a man and a woman.
